Terms & Conditions

General
These terms and conditions shall apply to all work carried out in the provision of services by Currie Computing Services Limited to the customer in accordance with any order confirmation authorised by the customer. No additions to, or modifications of, these Terms and Conditions shall have effect unless expressly agreed in writing by both parties and expressed to be amendments to these Terms and Conditions.

Delegate Suitability
It is the customer’s responsibility to ensure that the course is suitable for their requirements. All delegates should have read and understood the course overview / outline and met any necessary prerequisites listed.

Delegate Substitutions
Delegate substitutions may be made prior to the start of the course without penalty, providing that the replacement delegate is suitable and Currie Computing Services Limited have been appropriately informed either verbally or in writing. (See above)

Course Booking
Bookings can be accepted at any time up to the course start date, subject to availability. A written confirmation must be received from the customer in order to guarantee a place. Prior to your confirmation, your place is only held provisionally and Currie Computing Services Limited reserves the right to allocate provisional places to other customers, or to cancel courses that only have provisional delegates. Confirmed bookings may only be made online (provisional bookings can be made by telephone). On receipt online booking request, joining instructions will be sent to you.

Payment Terms
Full payment of fees is required 20 days prior to the start of the course, or immediately if the course is booked within 20 days of its start date. All prices quoted are exclusive of VAT.

Cheques should be made payable to Currie Computing Services Limited.

Cancellation and Transfer Policy
There may be occasion where you need to cancel or reschedule a course. If you wish to do this after your online order has been submitted, we will make every effort to accommodate your new requirements. However, as this involves additional costs, the following cancellation and rescheduling charges will apply.

You may cancel or reschedule your booking without penalty 20 or more full business days before the course start date.

For cancellations made within 20 full business days before the start of the course date, or if the delegate fails to attend the course, the Customer will be subject to 100% of the total invoice.

If a delegate wishes to transfer a booking to a later course less than 20 full working days before the scheduled course start date, there will be an administration charge of 25% of the course fee. If a course transfer is then subsequently cancelled at any time the course fee remains payable.

Currie Computing Services Limited reserves the right to cancel or reschedule courses and will advise you as soon as this change is known. Currie Computing Services Limited will use all reasonable endeavours to avoid changes of this nature.  However, in the unlikely event that a training course does not take place after Currie Computing Services Limited has issued registration confirmation, Currie Computing Services will make every effort to reschedule the course on an agreeable date.

Course Changes
The course listing is provided for information purposes only and does not constitute an offer for a particular course or programme. Currie Computing Services Limited constantly strives to improve the content of its courses and therefore reserves the right to modify the specification of a course without notice to the customer. The course title, duration, cost, content and location are liable to change at any time, in which case the client may be charged for any subsequent increase in course costs.

Training Times
Delegates will be advised accordingly of course start and finish times in their joining instructions.

Warranty and Liability
Warranty and Liability except as may otherwise be expressly provided in these Terms and Conditions and/or any applicable order confirmation, all warranties, conditions, terms, undertakings and representations of any kind whatsoever, express or implied, whether by statute, common law or otherwise, are hereby excluded to the fullest extent permitted by law and Currie Computing Services Limited shall have no other obligation, duty or liability whatsoever in contract, tort, statute or otherwise to the customer.

Currie Computing Services Limited represents and warrants that the services provided will be performed in a professional and skilful manner consistent with the professional standards and the general customs and practices of the industry. Currie Computing Services Limited further warrants that the services delivered under any order confirmation will conform in all material respects to the written specifications related thereto.

Currie Computing Services Limited maximum aggregate liability for any and all losses, claims, demands, damages, costs and / or expenses of any kind whatsoever arising out of or in connection with any order confirmation and / or these Terms and Conditions shall not, in total, exceed the amount actually paid by the customer to Currie Computing Services Limited for the services which are the subject of the order confirmation in question.

Currie Computing Services Limited maximum total liability for any and all losses, claims, demands, damages, costs and / or expenses of any kind whatsoever arising out of or in connection with any order confirmation and / or these Terms and Conditions shall not, in the aggregate, exceed the amount actually paid by the customer to Currie Computing Services Limited for the services which are the subject of the order confirmation in question.

The customer shall not be entitled to recover against Currie Computing Services Limited under any order confirmation and / or these Terms and Conditions more than once in respect of any one loss.

Currie Computing Services Limited shall not be liable to the customer for loss of profits and / or any incidental, consequential, special or indirect loss or damage arising out of or in connection with any order confirmation and / or these Terms and Conditions. This is including but not limited to the following:

Loss of business, loss of goods, loss of revenue, loss of use, loss of goodwill, loss of information, loss and / or corruption of data, loss of anticipated savings, downtime, and any damage relating to the procurement by the Customer of any substitute services.

Nothing in these Terms and Conditions and / or any order confirmation shall restrict and / or in any way exclude in any way Currie Computing Services Limited liability for either death or personal injury resulting from the negligence of Currie Computing Services Limited, its officers and / or employees, and / or fraudulent misrepresentation.

The Customer is liable for any loss damage or injury to Currie Computing Services Limited staff or their property, which may arise whilst working at the customer location, and is due to negligence or breach of statutory duty by the Customer.

Currie Computing Services Limited shall, in the event of the unavailability of any member of its staff, use all reasonable endeavours to provide alternative personnel to provide the services, but cannot be held liable for its failure to do so.

Currie Computing Services Limited accepts no liability for the failure of any third party hardware, software and / or systems, which may be the subject of any Currie Computing Services Limited services: this includes failure to meet its operating specification and / or its ability to process date-specific data.

Governing Law and Jurisdiction
These Terms and Conditions are governed by English Law and any dispute arising out of the Terms will be subject to the exclusive jurisdiction of the English Courts.
